AM VIP REWARDS PROGRAM MEMBERSHIP TERMS

These AM VIP Rewards Program Membership Terms (“Membership Terms”) were last updated November 17, 2025.

Please review these Terms carefully for the AM VIP Rewards Program.

Turn 5, Inc. (“Turn5,” “we,” or “us”) provides this AM VIP Rewards Program (the “AM VIP Rewards Program”), subject to your agreement to, and compliance with, these Membership Terms. These Membership Terms are incorporated by reference into the Terms of Use, available at www.AmericanMuscle.com/terms-of-use.html.

You acknowledge and agree that your choice to participate in the AM VIP Rewards Program is optional.  Turn5 may revoke, modify, or discontinue all or any portion of the AM VIP Rewards Program, at any time in Turn5’s sole discretion, with or without notice to you.

You understand and agree that your membership in the AM VIP Rewards Program indicates your acceptance of these Terms.  You also acknowledge and agree that membership in the AM VIP Rewards Program automatically renews on an annual basis, unless you opt out of renewal prior to the end of the then-current subscription term by clicking on the applicable non-renewal link within your user account.

Fees

Total fees for the AM VIP Rewards Program are $24.99 annually (“Program Fee”), charged in advance and on each anniversary thereafter, plus any applicable taxes.

AM VIP Rewards Program Benefits and AM VIP Cash Rewards:

The AM VIP Rewards Program provides certain cash rewards (“AM VIP Cash Rewards”) to individual consumers that make purchases through www.AmericanMuscle.com (the “Domain”):

Shipping: Unlimited free shipping on orders over $25 (excluding shipping, fees, and taxes).

Welcome Reward: One time welcome AM VIP Cash Reward in the amount of $20 will be added to your account within 10 days of purchase.

Renewal Award: An annual AM VIP Cash Reward in the amount of $10 will be credited to your account at your six (6) month AM VIP Rewards Program anniversary, and every twelve (12) months thereafter. By way of illustration:

Subscription date = 1/1/2026

Annual reward (1^st year) = 7/1/2026

Annual reward (2^nd year) = 7/1/2027

Annual reward (3^rd year) = 7/1/2028

Rewards for Purchases:

AM VIP Cash Rewards equal 5%, 10%, or 20%, as applicable, of the Purchase Price for purchases made through the Domain or via telephone. For purposes of earning AM VIP Cash Rewards, “Purchase Price” is the price paid for goods after any coupons or discounts are applied, before shipping, fees, or taxes. Certain products are excluded from the program. Please refer to the specific product page for details on AM VIP Cash Rewards eligibility. Purchases of gift cards do not earn AM VIP Cash Rewards. AM VIP Cash Rewards are not earned on the payment of any Program Fees.

AM VIP Cash Rewards may be redeemed on the next purchase made through the Domain or via the phone, or AM VIP Cash Rewards may be accumulated, subject the expiration terms set forth herein. AM VIP Cash Rewards will be redeemed and applied to the Purchase Price during the checkout process.

AM VIP Cash Rewards are not a credit, debit or gift card. Rewards have no cash value and are not eligible for cash back. Rewards are non-transferable to any other person or entity, nor are they eligible for use with any other merchant. Rewards are not eligible to be purchased separately.

Eligibility

The AM VIP Rewards Program is open to individual residents in the continental U.S. (excluding Guam, Puerto Rico, U.S. Virgin Islands and territories) who are 18 years or older and who have signed up for a AM VIP Rewards Program membership.

Earning Rewards

Purchases made through the Domain earn 5% AM VIP Cash Rewards on brands not owned by us or our affiliates, earn 10% AM VIP Cash Rewards for brands owned by us or certain of our affiliates, or earn 20% AM VIP Cash Rewards for Open Box. Certain products are ineligible for the program.

AM VIP Cash Rewards will be issued to your account via a promotional balance within 24 hours of shipment of the qualifying item.

Expiration

AM VIP Cash Rewards expire 90 days from the date of issuance.

Returns

·         If a purchase earned AM VIP Cash Rewards, and such purchase is returned, Turn5 will remove the earned AM VIP Cash Rewards from the purchaser’s AM VIP Rewards Program account.

·         If a purchase was made using AM VIP Cash Rewards, and such purchase is returned in compliance with the terms of sale, Turn5 will add the earned AM VIP Cash Rewards back to the purchaser’s AM VIP Rewards Program account. Such credited AM VIP Cash Rewards will expire on the original expiration date.  In the event such expiration date has already passed, purchaser will have no less than 1 month from the credit date before final expiration of such reward.

·         If a purchase earned AM VIP Cash Rewards, and the purchase is returned after such AM VIP Cash Rewards were redeemed, the refund amount for such purchase will be reduced by the amount of redeemed AM VIP Cash Rewards.

o   For example, if the Purchase Price of Order A is $100, the purchaser earns $10 in AM VIP Cash Rewards. If those AM VIP Cash Rewards are used on a subsequent purchase and then Order A is returned, the refund amount for Order A will be $90.

Turn5 may remove AM VIP Cash Rewards from a purchaser’s account and/or suspend access to the  AM VIP Rewards Program, in its sole discretion, if it is determined that a purchaser is attempting to use the return system to fraudulently earn AM VIP Cash Rewards or abusing the  AM VIP Rewards Program.

Disputes

Any dispute related to, or arising from, the AM VIP Rewards Program shall be resolved by final and binding arbitration instead of through courts of general jurisdiction or through class action. Participants in the AM VIP Rewards Program waive the right to participate in any class action claims.

THE AM VIP REWARDS PROGRAM IS PROVIDED ON A STRICTLY “AS-IS” AND “AS AVAILABLE” BASIS. TURN5 DOES NOT MAKE ANY REPRESENTATIONS OR WARRANTIES REGARDING THE AM VIP REWARDS PROGRAM OR THE AM VIP CASH REWARDS, WHETHER EXPRESS, IMPLIED OR STATUTORY, AND EXPRESSLY DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. YOU ACKNOWLEDGE AND AGREE THAT YOUR PARTICIPATION IN THE AM VIP REWARDS PROGRAM IS VOLUNTARY AND AS SUCH, TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL TURN5, OUR OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, SUBSIDIARIES, PARENTS, JOINT VENTURES, SUCCESSORS AND ANY OTHER COMPANIES UNDER COMMON CONTROL WITH US, OR ANY INDEPENDENT CONTRACTORS, BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT OR INDIRECT DAMAGES, LOST PROFITS OR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES ARISING FROM OR IN ANY WAY RELATED TO YOUR RELATIONSHIP WITH TURN5, INCLUDING YOUR PARTICIPATION IN THE AM VIP REWARDS PROGRAM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. WE DO NOT WARRANT THAT YOUR USE OF THIS SITE OR PARTICIPATION IN THE AM VIP REWARDS PROGRAM WILL BE UNINTERRUPTED, SECURE, OR ERROR FREE. PARTICIPATION IN THE AM VIP REWARDS PROGRAM IS AT YOUR SOLE DISCRETION AND RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGES AND/OR LOSSES RESULTING THEREFROM. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR LIABILITY TO YOU FOR ANY DAMAGES ARISING FROM OR IN ANY WAY RELATED TO THE AM VIP REWARDS PROGRAM, WILL AT ALL TIMES BE LIMITED TO THE AMOUNTS THAT YOU HAVE PAID TO TURN5 FOR THE PROGRAM FEE IN THE PRIOR TWELVE (12) MONTHS.  TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND TURN5 AGREE THAT ANY CLAIM BETWEEN US MUST BE BROUGHT WITHIN ONE (1) YEAR OF THE DATE THAT THE CLAIM AROSE.

SOME JURISDICTIONS, INCLUDING NEW JERSEY, DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OF CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU AND YOU MAY ALSO HAVE OTHER LEGAL RIGHTS THAT VARY FROM JURISDICTION TO JURISDICTION.
